The firm represents clients in all phases of criminal defense, civil rights claims and select personal injury matters, practicing in the federal and state courts throughout the New York City area at the trial, appellate and post-judgment stage of all proceedings.
Barket Marion also accepts clients with civil litigation involving complex issues of governmental policies and procedures. The firm currently represents 32 passengers in a lawsuit against JetBlue airlines regarding a pilot’s erratic behavior on a flight from New York City to Las Vegas as well as one of the victims of the NYPD shooting in front of the Empire State Building.
Founding partners Bruce Barket, Amy Marion, Steven Epstein and Kevin Kearon have each practiced law for more than two decades. Judge Elaine Jackson Stack focuses her practice preparing and arguing criminal and civil appeals as well as conducting matrimonial mediation and arbitration.
Daniel Arshack will oversee the New York office and continue to represent individuals and corporations in New York State, federal and international courts. His practice includes securities fraud litigation, financial crimes, money laundering, arms dealing, business loss, and foreign corrupt practices violations.
Bruce Barket is a former prosecutor who has built his reputation by winning numerous acquittals in high-profile cases involving crimes such as securities and mail fraud, murder and racketeering. He represents individuals and businesses in both federal and state court. He has also won post-judgment motions that overturned decades-old criminal convictions. He, along with several other lawyers, won the exoneration of Martin Tankleff who was wrongly convicted of killing his parents. Mr. Barket is a past president of the Nassau Criminal Courts Bar Association and a board member of the New York State Association of Criminal Defense Lawyers. He is the managing partner and will also oversee the firm’s Trial Practice Group and the Post Judgment Wrongful Conviction group.
Amy Marion began her career representing indigent defendants in the Criminal Defense Division of the New York City Legal Aid Society. She is now a fierce civil rights advocate, representing individuals in federal court who have been victims of police brutality or who have been falsely accused of a crime. Before joining Barket Marion, Ms. Marion served as the Principal Law Clerk to the Honorable Tammy S. Robbins, Nassau County Court Judge. Her experience of working within the system for a judge and representing indigent individuals makes her uniquely qualified to successfully litigate on behalf of her clients. Ms. Marion will lead the firm’s Civil Rights group.
Steven Epstein has become the lawyer of choice for anyone charged with a Driving While Intoxicated offense. Among those he has represented are lawyers, prosecutors and police officers charged with DWIs, as well as individuals charged with vehicular homicides. Mr. Epstein is the principal instructor for The Legal Aid Society of the City of New York in the area of DWI defense where he teaches hundreds of attorneys how to handle DWI cases. He is also a professor at Pace University Law School. Mr. Epstein will supervise the firm’s Vehicular Crimes group.
Kevin Kearon is a former Nassau County prosecutor who is now representing individuals in state and federal criminal trial courts in New York. He has extensive experience successfully defending major felonies including murder, sex crimes, white collar crimes, narcotics trafficking, and Medicaid, no-fault, mortgage and tax fraud. He is a past president of the Nassau Criminal Courts Bar Association and a former chief of the Mental Health and Hygiene Unit of the Nassau County District Attorney’s Office. Mr. Kearon will lead the Criminal Trial group.
